Terms of service

These terms apply to work performed and materials supplied by the RBS Build Works companies, RBS Services LLC, RBS Termonde LLC and RBS Estaires LLC (each "we", "us"), 47 Pleasant Street, Suite BS, Northampton, MA 01060. Each job is performed and invoiced by one company, named on the quote and the invoice. Building contracts issued by RBS Estaires LLC contain their own terms; where they differ, the signed contract controls.

Quotes and scope

Quotes are written from plans, a site visit or photos and are valid for 30 days. They state the scope, the price in US dollars, what is excluded, and the schedule. Work outside the scope is priced as a written change order and approved by you before it is done.

Site conditions

You agree to provide access, power, and a site ready for our stage (framing inspected and mechanicals complete before insulation; insulation inspected before board). Time lost to an unready site, or to clearing other trades' debris, is billed as labor at the quoted rate.

Payment

Builders and property managers on approved account: Net 30 from invoice date, with any early-payment discount stated on the invoice. Homeowners and renovation clients: deposit at signing, stage payments as work completes, balance at completion. Building contracts: deposit, draws and balance per the contract. Accepted methods: card, ACH debit, bank transfer and check. Balances more than 30 days past due accrue 1.5% per month or the maximum allowed by law, and we may pause scheduled work until the account is current. Charges appear on statements as RBS SERVICES LLC, RBS TERMONDE LLC or RBS ESTAIRES LLC.

Warranty

Workmanship is warranted for one year from completion of the stage against defects in installation (including nail pops and cracked joints caused by our work). Materials carry their manufacturers' warranties. Excluded: damage by other trades, structural movement, moisture intrusion not caused by us, and normal settling.

Liability

To the extent permitted by law, our liability for any claim arising from a job is limited to the amount paid for that job. We carry general liability and workers' compensation insurance; certificates are available on request.

Territory and governing law

We work within the United States. These terms are governed by the laws of the Commonwealth of Massachusetts, except that lien and construction-contract provisions follow the law of the state where the work is performed.
